SUBJECT:- Human Rights violation
and injustice resulting in failure of police duty performance.
Sirs,
World
biggest Human Rights violation, biggest social injustice against the most
innocent and the UN conserved tribal case exposed by the one man army of India
Mr Jaswant Singh Janpangi.
Uttrakhand
High Court stated President is not King, then who is king? Does anybody have
right to play with the law and constitution of this nation?
Does
anybody have the right to play with the lives of helpless tribal?
Chief
Justice, Chief Minister, Governor, Chief Secretary, Principal Secretary of
Uttarakhand need to be charged with criminal conspiracy and tried in the court
of law for prosecution clubbing this message with the ongoing matter under the
PMO monitoring, pertaining to tribal custodial death and children convicts
under life term.
This
matter is a subject of the UN charter for children as well as conservation of
sub-original tribes. Protection and conservation of the Himalyan Raji tribal
within the 5-kilometre buffer zone habitat. Violation of this buffer zone
attracts 7 year imprisonment and Rs. 10, 000 fine. The vanishing Himalyan Raji
tribal at district Pithoragarh, Tehsil Dharchula, Didihat has been victimized
by the, principally, police created fatal atrocities and misconduct.

Gagan
Singh and Jagat Singh sons of Jeet Singh and Mohan Singh respectively of Gram
Jamtadi, PO Jamtadi Ascot, District Pithotragarh charged with case No. 161/2005
sec. 221, 302, 504, 506 are serving life term in Uttarakhand jails after being
tried as adults in spite of being 12 and 14 years of age only covered under the
Juvenile Act. All legal proceedings against them were carried out as adults and
there was no one for their support at inception and later as well only I am
their only supporter while police has been treating them with reckless
disregard. The district judge was unable to properly consider the case
attributable to the police conspiracy.
I
am struggling form foot paths for about 10 years, and for 3 years now I have
not visited my home and succeeded to get media attention towards this crucial
news and information of mass interest.
After
being proved minors, the children cannot be allowed to share prison space with
adults. Justice needs to be done towards the children as Delhi High Court has
held. The High Court took cognizance of the matter through news published in
the Indian Express daily and report was sought from the Uttarakhand Government
under which an inquiry was set up under the direction of Superintendent of
Police Pithotragarh. Village Head and Village Development ,Officer referred the
population register and stated that at the time of the incident the children
were only 12 and 14 years only, their conduct was good and local people have no
objection towards their release.
Under
this inquiry Thana Incharge of Ascot realized bribe of Rs. 3,000 from the
parents and the Village Head which can be verified form the Village Head
Govind Singh Bhandari on his mobile phone no. 9411333142. This is the most
hideous and degenerated version of the Uttarakhand police. Under the above
matter the fact of victim being minors at the time of the incident has also
been proved in the Child Commission.
The
report that got presented to the Chief Justice, Governor, Chief Minister, Chief
Secretary, State Legal Services Authority Secretary where it has been declared
by former Child Commissioner Mr Ajay setia that under the verdict of the
Uttarakhand High Court on pattern of the Delhi High Court inspected all
Uttarakhand jails and revealed that 68 minor children have been wrongly
sentenced by the Uttarakhand courts in defiance of the Juvenile Act after the
year 2000 among who 2 are the Raji tribal victims under life term which is
wrong and need to be released immediately. Hon'ble Supreme court has also held
that without parole life term is more severe than capital punishment.

Conserved
Himalyan Raji tribal Man Sing s/o Inder Singh,Gram Jamtadi vide FIR No. 99/2007
dated 10 July 2007 section 290-91 Thana Jojebi, District Pithoragarh is missing
from police custody till date. In this matter under my complaint to the Police
Complaints Authority (PCA) vide complaint No. 2/2010 Jaswant Singh v/s Jojebi
police I have made tremendous efforts to prove to the PCA that in the year 2007
tribal Man Sing has been put to police custodial death the stand which
PCA has also upheld and on 31 December 2015 directed the Principal Secretary,
Uttarakhand to get the matter investigated and by any independent agency, but
the police. The principal Secretary with his utter inhumanity dumped this
direction of the PCA in dust bin and stalled the matter for which he too
has been proved to be an element among the conspirators, and hence need to be
tried for prosecution.

a.) Uttarakhand police in the PCA has claimed that the tribal Man Singh is
legal absconder due to which his wife has also got deprived of widow pension.

b.) In PCA, the Uttarakhand police claims that the tribal Man Singh has
ambushed in Nepal. This is police and State Government's duty to to extradite
him to India from this most favoured and most friendly visa-free nation for
Indians as India got Abu salem extradited for the indifferent Portugal. Former
legislator Gagan Singh Rajwar, BDC member Hira Singh Samant, senior police
officers and others conspired to protect the culprit police which has been
brought to public light by me, hence these need to be charge sheeted too.
The
Chief Secretary, Chief Minister, Governor, Chief Justice, High Court,
Uttarakhand State Legal Services Authority Secretary never took cognizance of
the matter and damaged national prestige hence needs to be tried for sedition,
who made me sit on Humger strike at the national protest site at Jantar Mantar
sinc e 3-Sept., 2016 and left recently being in danger by the culprits and
their protectionists.
This
petition is indicative and needs to be acted upon to prevent immediate future
predicament of the mass and the state machinery.

Rashtrapati Raja nahi hota, decision by UK Highcourt but here people are seemingly above law and no one bothering Human Rights and that too Children and that too of UN and GoI conserved tribal.
I have got proved that tribal got custodial death where Police Complaints Authority has also accepted my stand. Evidences above, which were dumped by Harish Rawat Government in bin. All this is happening as no political power is enjoyed by the Himalyan tribal.
